The Supreme Court of India deliberated on the legality of bulldozing properties solely due to criminal charges against the owners. The bench stressed that demolitions must follow legal protocols. Solicitor General Tushar Mehta affirmed that properties can’t be bulldozed for criminal associations. The term ‘Bulldozer justice,’ as referred to by the public, is a form of instant justice mechanism involving the razing of houses, shops, or any premises belonging to individuals accused of a crime.

Relying on the legal principle of ”bail is rule and jail is exception” cited by a coordinate bench, the top court said pre-trial incarceration cannot be a punishment.
