A divorcee Muslim woman can seek alimony from her husband under Section 125 of the Code of Criminal Procedure, the Supreme Court ruled today. The big judgment came as a bench of Justice BV Nagarathna and Justice Augustine George Masih dismissed a Muslim man’s petition challenging a direction to pay maintenance to his divorced wife under CrPC.

The bench made it clear that the law for seeking maintenance applies to all married women, irrespective of their religion. Justice Nagarathna and Justice Masih delivered separate, but concurrent, judgments.

Mihir Shah – the main accused in the Mumbai BMW hit-and-run case – has admitted that he was driving the car when the accident occurred, but claimed he wasn’t drunk, police sources have said.

Mihir Shah was arrested last evening. A total of 12 people, including Shah’s mother and two sisters, were taken into custody.

The police had formed multiple teams to catch Mihir Shah, who was eventually tracked down to an apartment in Virar, which is around 65 km from Mumbai.

The Mamata Banerjee government’s challenge to the Centre over the CBI investigating West Bengal cases without the state’s consent is valid, the Supreme Court ruled today.

The order came as a twist after the court recently allowed a CBI probe into the multiple cases of sexual assault and land grabbing in the island of Sandeshkhali – despite opposition from Bengal.

The Bengal government had approached the Supreme Court against the CBI over filing cases despite the state withdrawing its general consent to the central agency in 2018.

A bench of Justices BR Gavai and KV Vishwanathan today rejected the Centre’s contention that facts have been concealed in Bengal’s petition, which they held was maintainable.
